Terms of Service

These Terms of Service ("Terms") constitute a legal agreement between Geneva Projects Sdn. Bhd. ("Edventure+", "we", "our", or "us") and you ("User").

By accessing or using our platform at https://edventure.plus or our mobile applications (iOS/Android), you agree to be bound by these Terms.

1. ELIGIBILITY AND PARENTAL CONSENT

1.1 Age Requirements

Edventure+ is designed for students aged 3-25 years, with primary focus on primary school through SPM students (ages 6-17).

1.2 Parental/Guardian Consent (For Users Under 18 in Malaysia)

If you are under 18 years old in Malaysia (the age of majority), a parent or legal guardian must:

• Create and manage your account
• Review and consent to these Terms and our Privacy Policy
• Maintain full control over your profile, data, and subscription

Students cannot create accounts directly. All accounts must be parent/guardian-managed.

1.3 Lawful Use

You agree to use the Platform for lawful educational purposes only and not for commercial, political, or harmful activities.

2. ACCOUNTS AND AUTHENTICATION

2.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Do not:

• Impersonate others or use false information
• Share login access with unauthorized persons
• Create multiple accounts to abuse free trials or promotions

2.2 Google Sign-In

When signing in with Google, you authorize Edventure+ to:

• Access your Google account information (name, email, profile photo only)
• Create and maintain your Edventure+ account
• Use your profile data for authentication and personalization

Your use of Google's services is also subject to Google's Terms of Service and Privacy Policy.

2.3 Account Types

• Parent/Guardian Account: Full control over student profiles, subscription, and settings
• Student Profile: Managed by parent/guardian, used for learning activities only

3. SUBSCRIPTION AND PAYMENT

3.1 Free and Premium Plans

FREE PLAN:

• Access to limited practice questions
• Basic progress tracking
• General knowledge quizzes

PREMIUM PLAN:

• RM28 per month (monthly billing)
• RM280 per year (annual billing, save 17%)
• Unlimited access to all subjects (Darjah 1 through Tingkatan 5 - covering 11 grade levels: 6 primary + 5 secondary)
• Full quiz bank (10,000+ questions) across Matematik, Bahasa Melayu, Bahasa Inggeris, Sains, and Sejarah
• Adaptive difficulty system with AI-powered smart grading
• EdTag username for leaderboards
• XP and reward system with mystery boxes and tournaments
• Priority support

3.2 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information.

By subscribing, you authorize:

• Automatic recurring charges to your payment method
• Charges at the start of each billing period
• Price increases with 30 days advance notice

3.3 Free Trial

New users may receive a free trial period (if offered). You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

3.4 Cancellation Policy

You may cancel your subscription at any time through:

• Parent dashboard in the app
• Contacting hello@edventure.plus

Cancellation takes effect at the end of your current billing period. You will retain access until then. No partial refunds for unused time.

3.5 Refund Policy

We offer refunds within 7 days of purchase if:

• You experienced technical issues preventing app use
• You were charged in error
• The app did not meet advertised functionality

To request a refund:

• Email hello@edventure.plus with subject "Refund Request"
• Include your account email and reason
• Refunds processed within 14 business days

No refunds after 7 days or if you have extensively used the service.

3.6 Family Accounts

One subscription covers unlimited student profiles within the same parent/guardian account. You may not share subscriptions across multiple parent accounts.

4. USER CONTENT

4.1 Ownership

You retain ownership of any content you create or upload ("User Content"), including:

• Quiz answers
• Profile information
• EdTag username
• Progress data

4.2 License to Edventure+

By submitting User Content, you grant Edventure+ a non-exclusive, royalty-free, worldwide license to:

• Store and display your content for platform functionality
• Use anonymized data for learning enhancement and platform improvement
• Share progress data with your parent/guardian account

4.3 Content Moderation

We may remove or disable content that:

• Violates these Terms or applicable laws
• Contains offensive, harmful, or inappropriate material
• Infringes intellectual property rights
• Poses security or safety risks

5. EDTAG ANONYMIZATION SYSTEM

5.1 EdTag Usernames

Students may create optional EdTag usernames (e.g., @star_learner) for use in:

• Leaderboards
• Competitions
• Public rankings

5.2 Privacy Protection

• Real names are NEVER displayed in social features
• EdTag is optional - you can use the platform privately
• Parents control participation in social features
• EdTag can be changed at any time

5.3 EdTag Rules

EdTag usernames must not:

• Contain real names, addresses, or personal information
• Be offensive, vulgar, or inappropriate
• Impersonate others
• Violate any person's rights

We reserve the right to change or remove EdTags that violate these rules.

6. PROHIBITED CONDUCT

You agree not to:

• Use bots, scrapers, or unauthorized automation
• Hack, reverse-engineer, or disrupt platform operations
• Upload malicious code, viruses, or harmful data
• Collect or use other users' data without consent
• Share or sell account access
• Cheat on quizzes or manipulate scoring systems
• Harass, bully, or threaten other users
• Post spam, advertising, or promotional content
• Violate any applicable laws or regulations
• Use the platform for any commercial purpose without authorization

Violations may result in immediate account suspension or termination.

7. INTELLECTUAL PROPERTY

7.1 Platform Ownership

All platform materials are the property of Geneva Projects Sdn. Bhd. or its licensors, including:

• Questions, quizzes, and educational content
• Software, code, and algorithms
• Design, graphics, and user interface
• Branding, logos, and trademarks
• AI grading system and adaptive learning technology

7.2 Restrictions

You may not:

• Copy, modify, or distribute platform materials
• Reverse engineer or decompile software
• Remove copyright or proprietary notices
• Use content for commercial purposes
• Create derivative works without written consent

7.3 User Feedback

Any feedback, suggestions, or ideas you provide become the property of Edventure+ and may be used without compensation.

8. SERVICE AVAILABILITY

8.1 Platform Access

We aim to provide continuous access but do not guarantee uninterrupted or error-free operation.

Service may be temporarily unavailable due to:

• Scheduled maintenance
• System updates and improvements
• Third-party service interruptions
• Force majeure events

8.2 Platform Changes

We reserve the right to:

• Modify, suspend, or discontinue features
• Update content and curriculum
• Change pricing with 30 days notice
• Improve or alter platform functionality

9. TERMINATION

9.1 Termination by Edventure+

We reserve the right to suspend or terminate accounts that:

• Violate these Terms or applicable laws
• Engage in fraudulent or abusive behavior
• Pose security or safety risks
• Remain inactive for extended periods

Termination may occur without prior notice in cases of serious violations.

9.2 Termination by User

Users may terminate their account at any time by:

• Contacting hello@edventure.plus
• Following account deletion process in app settings

Upon termination:

• Access to paid features ends immediately (or at end of billing period if subscription active)
• All user data will be deleted within 30 days (unless required by law)
• Unused subscription time is non-refundable (unless within 7-day refund window)

10. DISCLAIMER AND LIMITATION OF LIABILITY

10.1 No Warranties

The Platform is provided "AS IS" without warranties of any kind, express or implied, including:

• Fitness for a particular purpose
• Accuracy of content
• Uninterrupted or error-free operation
• Security of data transmission

10.2 Educational Use Only

Edventure+ is a supplementary educational tool. We do not guarantee:

• Academic success or grade improvement
• Exam pass rates
• Admission to schools or programs
• Specific learning outcomes

10.3 Limitation of Liability

To the maximum extent permitted by law, Geneva Projects Sdn. Bhd. shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use the Platform
• Errors, bugs, or technical issues
• Third-party actions or content
• Unauthorized access to your account

Total liability shall not exceed the amount paid by you in the 12 months prior to the claim, or RM100, whichever is less.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Geneva Projects Sdn. Bhd., its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your misuse of the Platform
• Your User Content
• Your violation of any law or third-party rights
• Any harm caused to other users or third parties

12. DATA PROTECTION AND PRIVACY

12.1 Privacy Policy

Your use of Edventure+ is subject to our Privacy Policy, which is incorporated into these Terms by reference.

12.2 Compliance

We comply with:

• Personal Data Protection Act 2010 (PDPA Malaysia)
• Children's Online Privacy Protection Act (COPPA USA)
• General Data Protection Regulation (GDPR Europe)
• Malaysian Ministry of Education (KPM) standards

12.3 Data Processing

By using the Platform, you consent to:

• Collection and processing of personal data as described in our Privacy Policy
• Data storage in Singapore and other jurisdictions
• Sharing of limited data with essential service providers (Supabase, Stripe, Expo, Google)

12.4 Children's Data

For users under 18:

• All data collection requires parental consent
• Parents have full access to student data
• Parents may request data deletion at any time
• Children cannot directly modify or delete their profiles

13. DISPUTE RESOLUTION

13.1 Informal Resolution

Before filing any legal claim, you agree to first contact us at hello@edventure.plus to attempt informal resolution.

13.2 Governing Law

These Terms are governed by the laws of Malaysia, without regard to conflict of law principles.

13.3 Jurisdiction

Any disputes shall be resolved under the exclusive jurisdiction of the Malaysian courts in Kuala Lumpur.

13.4 Arbitration

For disputes involving amounts less than RM10,000, parties agree to binding arbitration under the Rules of the Asian International Arbitration Centre (AIAC).

14. CHANGES TO TERMS

14.1 Updates

We may revise these Terms periodically to reflect:

• Changes in our services or features
• Legal or regulatory requirements
• Industry best practices
• User feedback and platform improvements

14.2 Notification

Significant changes will be notified via:

• In-app notification
• Email to registered parent/guardian account
• Notice on our website

14.3 Acceptance

Continued use of the Platform after updates means you accept the new Terms. If you do not agree, you must stop using the Platform and may request account deletion.

The "Effective Date" at the top of this document indicates when the current Terms came into effect.

15. GENERAL PROVISIONS

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Edventure+ regarding use of the Platform.

15.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions shall remain in full effect.

15.3 No Waiver

Failure to enforce any provision does not waive our right to enforce it later.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to affiliates or in connection with a merger or sale.

15.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control (natural disasters, pandemics, war, government actions, etc.).

15.6 Language

In case of conflict between English and Bahasa Melayu versions, the English version prevails.

17. ACKNOWLEDGMENT

By clicking "I Agree", creating an account, or using Edventure+, you acknowledge that:

• You have read and understood these Terms
• You agree to be bound by these Terms
• If you are a parent/guardian, you consent on behalf of your child
• You have read our Privacy Policy
• You understand your rights and obligations
